Horticulture Award Changes Are Now Live: Your Final Compliance Checklist
By The Yield Australia Team ·
The Horticulture Award changes that we previewed in June are now in effect as of 1 July 2026. This isn't a future obligation any more — every pay run from this week forward needs to comply. Here's a practical checklist for growers who employ harvest, packing or nursery staff.
The Checklist
- Piece-rate minimum guarantees. Confirm every piece-rate worker's earnings are being reconciled against the minimum guaranteed hourly rate for each pay period, and that top-ups are being applied automatically where picking conditions reduce output.
- Written piece-rate agreements. Check that every piece-rate arrangement is documented, signed and on file — verbal arrangements don't satisfy the record-keeping requirements.
- Updated pay rates. Apply the new minimum award rates from the first full pay period on or after 1 July. If your payroll software hasn't updated its award tables yet, chase your provider now.
- Record keeping. Hours worked, output recorded, and rate calculations must all be retrievable. If the Fair Work Ombudsman asks, you want to produce records in minutes, not weeks.
- Labour-hire arrangements. If you use contractors or labour-hire firms, ask them to confirm in writing that their arrangements comply. Host employers can carry exposure for underpayments on their sites.
If You're Not Sure
The Fair Work Ombudsman ran education-first compliance through the transition, but that posture firms up as the new arrangements bed in. If you're uncertain about any element, get advice now: your industry association (AUSVEG VIC and Voice of Horticulture both ran winter workshops), your payroll provider, or an employment lawyer for anything complex.
Why We Keep Talking About This
Labour is the single biggest input cost on most vegetable operations, and compliance failures compound quickly — back-payments, penalties and reputational damage all land at once. A half-day payroll review now is the cheapest insurance you'll buy this financial year.
We'll keep monitoring how the changes settle in and share anything material through the Industry News dashboard and this blog.
